FIRST AMENDED COMPLAINT
Plaintiff, Naomi Johnson, sui juris, one of the People under the U.S. Constitution, amends her complaint (Fed. R. Civ. P. 15) against Defendants for violations of unalienable rights, seeking $10,000,000 and equitable relief.
JURISDICTION: This Court has jurisdiction under 28 U.S.C. § 1331 (federal question) and 42 U.S.C. § 1983 (civil rights). Supplemental jurisdiction over state claims (NJLAD, N.J.S.A. 10:5-1) via 28 U.S.C. § 1367.
FACTS: On February 24, 2025, Sgt. Maza towed Plaintiff’s automobile without accommodation for her disability (tremors, 49 CFR § 37.3), stranding her (ADA, 28 C.F.R. § 35.130; NJLAD). Glen Ridge Municipal Court issued a $500 warrant and $55 tickets without consent or proper service (R. 7:8-9; Mullane v. Central Hanover Bank, 339 U.S. 306 (1950)). Defendants ignored Plaintiff’s notices/motions (March–Sept 2025, certified mail: [List Tracking Numbers]), admitting liability (16 Am. Jur. 2d § 155).
CAUSES OF ACTION: a. 4th Amendment: Unlawful tow (Soldal v. Cook County, 506 U.S. 56 (1992)). b. 5th/14th Amendments: Due process violation (improper warrant, no consent for “account”). c. 6th Amendment: Denial of virtual hearing (Bounds v. Smith, 430 U.S. 817 (1977)). d. 14th Amendment: Equal protection (potential racial profiling, Yick Wo v. Hopkins, 118 U.S. 356 (1886)). e. ADA/NJLAD: No accommodation (28 C.F.R. § 35.130; N.J.S.A. 10:5-4). f. Forfeiture: Defendants’ oath violations (N.J.S.A. 41:2-1; N.J.S.A. 40A:5-34) trigger bond forfeiture (Blackstone IV: 132, forfeitures odious without consent). Bar oaths as “nobility” under Titles of Nobility Amendment (1810) void statutory overreach (Loper Bright Enterprises v. Raimondo, 603 U.S. ___ (2024)).
RELIEF: $10,000,000 ($575 tow, $100,000 distress, $9.9M punitive/bond forfeiture), warrant/ticket vacatur, injunction against municipal proceedings, bond forfeiture (N.J.S.A. 40A:5-34).
