 Notice of Unlawful Administrative Warrant

The administrative warrant issued against me states that I “failed to appear” at a scheduled court date for a traffic summons. This warrant is unlawful for the following reasons:

1. Improper Basis for Warrant

◦ Under New Jersey Court Rules, traffic summonses allow a defendant to enter a plea by mail or in writing. A warrant may not be issued unless there is a clear legal requirement for a personal court appearance.

◦ The traffic summons I received did not state that a court appearance was mandatory.

2. Timely Filing of Answer

◦ I submitted a written answer and defenses several days before the scheduled date. This satisfies the procedural requirement to respond.

◦ The issuance of a warrant despite my timely filing constitutes a violation of due process.

3. Constitutional and Statutory Violations

◦ Issuing a warrant under these circumstances exceeds the court’s lawful authority and violates my rights under the U.S. Constitution (Amendments V & XIV) and the New Jersey Constitution (Art. I, §§1, 10).

◦ A traffic summons for a minor regulatory matter is administrative in nature and cannot be escalated into a criminal enforcement action without independent, constitutionally valid grounds.
