Essex County Prosecutor’s poor Investigation of Deshon Johnson’s NJ Transit/Coach USA bus driver case

The bus driver did not stop to pick up Mr. Johnson at the bus stop. He kept going speeding around the corner jumping the curb where the 22-year-old young man stood knocking him down where the construction work was being done on the county road near the bus stopped. One of the merchants stated that the young man was dragged 50 to 100 feet and ended up by the brook.
Essex County Prosecutor did not charge the bus driver with any charges. According to Chief Assistant Mr. Thomas Fennelly, he stated, that the reason the bus driver was not being held with any charges was because it was not his intention to kill someone…this was a freak accident.” Mr. Thomas then stated, “the bus driver probably did not see Mr. Johnson. According to the Chief Assistant prosecutor, he stated Mr. Johnson allegedly was knocking on the back door or window using both hands jumping up and down.Essex County Prosecutor Detective Contreras stated that Mr. Johnson was running across Bay Street to catch the bus, therefore, they do not see any criminal attention. Detective Contreras also stated, " The incident happen on Bay Street in Bloomfield NJ". Bloomfield Mayor McCarthy stated The incident happen on Broad Street.
According to further investigation, it shows that Mr. Johnson left seven eleven stores at 10:30 am and was sitting at the bus stopped ahead of time waiting for the 10:48 am bus arrival. Therefore, Deshon was not running across (Bloomfield town road) Bay Street as the detective stated because he was already at the bus stop. Now the questions are, what are Essex County Prosecutors hiding? And why is the bus driver not charged with 22-year-old Deshon Johnson death as a vehicular homicide?
In a recent article, there was a man killed in Passaic N.J. and the bus driver was charged with vehicular homicide and $50,000 bail. Ms. Johnson stated, "I am sure the bus driver attention was not to go out and kill 49-year-old Mr. Joseph Currier. Also, I am sure she did not see Mr. Currier yet she was charged". According to the article, she was operating the bus in a reckless manner by allegedly passing through a red light. I n another recent article there was another case when a bus hit a 48-year-old woman in DURHAM, N.C. — Durham police have charged a city bus driver with involuntary manslaughter in an accident that killed a pedestrian. In September, 48-year-old Johnnie Chavis was making a turn when he hit and killed Katie McClary, who was crossing Broad Street. McClary was taken to Duke University Hospital, where she was pronounced dead a short time later. Ms.Johnson stated, "I am sure this bus driver attention was not set on killing this woman and he probably did not see her but he was charged with criminal actions". In Mr. Johnson case the bus driver did not stop at its assigned pick up spot speeding around the corner and jumping the curb. The footage was showed on one of the store merchant cameras. I see in all three cases were negligent are on the bus drivers.
In another article, there were three boys hit by an NJ Transit train jumping the curb killing two and injured the other. The two boys were killed names are Alan Mendez, 16, and Nicholas Sabina, 17, on Oct. 2 last year when they were unable to outrun an unscheduled train on the Montclair-Boonton line. Their friend, Darian Robinson, survived but suffered injuries jumping onto an embankment.
Law of action was rendered. Actions were taken by NJ Transit also include the installation of new fencing at the River Edge Station and the removal of brush at a station in Atco, a section of Waterford Township in Camden County, to improve visibility for train engineers. State Transportation Commissioner Jim Simpson, who said as a father of four he was personally moved by back-to-back deaths last fall, began spearheading the public safety campaign that focuses on three areas — educating the public, enforcing trespass laws, and reexamining the rail network to identify whether improvements could be made to the engineering. Simpson said the safety gates were down at the intersection of the tracks and Outwater Lane to block cars, but there was no shorter arm to block pedestrians. Simpson said Friday that NJ Transit installed a gate for pedestrians and put on a sidewalk after Cabaj’s death. Since the tragedy, NJ Transit has installed additional “No Trespassing” signs in Wayne between Hobson Avenue and Main Street.“With all our efforts, I’d like to get to zero fatalities,” Simpson said.

Being that both victims did not have any clue that the train or bus will jump the curb there should be a law to prevent this incident from occurring. However, that was not the case with Deshon! NJ Transit, Coach USA or lawmakers did not attempt to put any law together to prevent future tragedy from happening.
Now with Deshon Johnson tragedy, there was no law in place or actions taken to prevent bus jumping the curb nor was any charges brought against the bus driver. Now in the three cases, the victims were not Afro-American like Deshon.
Essex County Prosecutor is protecting the guilty and not defending the victim. What ever happen to pedestrians always have the right away? Are there double standards when it comes to race?

It's so sad all these boys have died. In the case of Deshon, it isn't clear to me whether Deshon jumping up to hit the window contributed to his getting caught by the bus and dragged. The questions there are, why did the bus driver blow by the stop in the first place and then drive up on the curb?
ReplyDeleteIn the case of the boy caught on the train trestle, I ask myself, why was there no pedestrian crossing for these boys? Apparently it had been known for many years that children used the trestle to cross over a busy roadway to get to the mall? Couldn't the city or the mall provide for children's safety by installing safe pedestrian crossing for them?
