1. You Preserved Your Record

  • Serving an Affidavit of Rebuttal and an Affidavit of Truth puts your objections and facts on record.

  • Serving a Tort Claim Notice within 90 days of the incident (as the law requires) preserves your right to later sue the police department and officers in New Jersey state court for damages.

2. If the Tort Claim Was Ignored

  • Agencies often do not respond to Tort Claim Notices. That’s normal. The purpose is not to “cure” but to give notice so they cannot later say they were surprised by your lawsuit.

  • After six months from filing the Tort Claim Notice, you are allowed under NJ law to bring a lawsuit in Superior Court (usually Law Division, Civil Part) for damages.

3. Parallel Federal Path

  • State Level:
